The Issue: A medical staffing agency had a vacancy, and was in the midst of interviewing for the purpose of hiring. They contracted NationSearch to perform their background screenings, as a matter of due diligence, in order to uncover any criminal records that the applicant might have.
The Action Taken by NationSearch.com:
During the process of the criminal records disclosure, NationSearch.com performed the following Comprehensive Criminal screenings....Nationwide Criminal Database/Sex Offender Search, Statewide Criminal Records Search, State Specific Sex Offender Registry, Federal Criminal State Specific District Court Search, County Criminal search, Colorado Courts Integration search, Social Security Number and Address Trace.
The client's decision to use our most exhaustive, comprehensive search, resulted in finding that the applicant is a registered sex offender, in the state of Colorado. The applicant was formerly an employee in the Colorado State Penal System, and had been charged with official misconduct, and inappropriate sexual contact with a prisoner, a felony, in 2006. The applicant plead guilty, and was given a 4 year deferred sentence, 12 months probation and sentenced to 60 hours of community service, plus fines.
This individual went on to incur charges of driving while under restraint, not only in 2006, but in 2009. Then was charged with false reporting of false information, in 2009, which landed them 12 months probation, 24 hours of community service, and court costs and fines.
The sad part of this story is that this individual will be branded a sex offender for life, and will always need to register as one no matter where they go, in the US. This distinction is with them for life.
