The Issue:
An individual was seeking employment, and in fact, had already been hired by a company who employs people to take pictures of persons attending various venues, such as baseball games, snow skiing, water parks, amusement parks, etc.
The company chose to hire first, and do the background screening after the fact, due to the immediate need for photographers.
Action Taken by Nation Search:
Nation Search conducted their Comprehensive Criminal Screening, which consisted of: Department of Corrections search, county criminal search, SSN/Address Trace, state specific sex offender registry and a Federal criminal, state specific, district court search.
Results of Investigation:
The search results turned up the fact that this individual had a bank robbery, possing insturment of crime and murder in his background, from 1997. Possession with intent to manufacture and deliver, a controlled substance, and carrying firearms without a license, from 1994. This individual was sentenced to 8-17 years in prison, and is currently out on supervised parole. He was fined several million dollars.
This is not a guy you want taking pictures of you and your family.
Upon learning of this, the individual was immediately fired from his place of employment.
This is a sad story that we hear about altogether too often. This individual may have completely turned his life around, however, we all make decisions that have consequences, and we have to live with the repercussions of those decisions and consequences.

This story is about the author's mother, and her Home Owners Associations irresponsible hiring of a construction crew, and the tragedy that could have been avoided, had a background screening been requested by the HOA.
One summer day, a construction crew showed up in my mother's complex to stucco the exterior of the 150+ homes within her associations complex. She had been notified this work was to be done, as were the other home owners.
I believe that when these types of situations occurr, that the homeowner has the right to assume that the HOA has completed the necessary due diligence in order to make every effort to insure that the association members are not placed in danger.
NOT THE CASE AT ALL. ASSUME NOTHING!
Mom had planned a vacation out of the country for that summer. She left early in the morning. I received a phone call from the police, at about 2 a.m. the following morning. A man had cut the phone lines going into her home, broken down the front door, and crashed through her picture window.
I live close, and was able to get to her home within about 10 minutes, where I was greeted by the police, and her next door neighbor. The neighbors had been awakened by loud noises, and upon realizing what was going on, had called the police, and held a gun on the intruder and his vehicle (unbeknownst to the intruder), in order that they might stop him from leaving the scene prior to the police arriving.
The man was a very large, tall man, weighing over 300 lbs. My mother is a very petite women, weighing around 110-115 lbs. The investigators put the crime scene together, and told me that the man had gone right upstairs to where he knew her bedroom was located, jumped from the door to her bed, in the dark, bringing down the ceiling fan onto the bed. Upon finding that my mother was not in bed, he became enraged, and literally destroyed her home. Her bedding was pulled off and placed in his truck. He tossed her Grandfather clock, which had been handmade by her deceased father, over his shoulder, took it outside and let it fall across the bed of his truck, etc., etc. The man was found to be drunk and on methanphetamines, cocaine, and marijuana, among other things. It required 8 policeman to get him under control, handcuffed, and in a patrol car....then the same manpower, to get him out of the car and into a jail cell.
The investigator told me that his investigation concluded that he would most definitely have killed my mother, had she been in the bed.
Had a background screening been performed, the HOA would have found that this man had spent considerable time in 2 separate Federal Penitentary's for aggravated rape, burglarly, drug charges, etc. Each offense had become progressively more violent.
He should have never been allowed on the property. The Construction company was at fault, also, for not performing their due diligence.
The situation was tragic, in that he destroyed many, many items that had been handmade by my mom's deceased father that were very close to her heart. The insurance company helped her to find restoration companies that were able to restore most of the items.
We count our blessings that she was not in her house that early morning.
The man spent 2 years out on bond, in my mother's neighborhood, which was absolutely terrifying to her, before his court case came up. He then left the state, and it took another 3 years, or so, to locate him and bring him back to our state to stand trial. He was eventually sentenced to 12 years in prison. He came up for parole every 6 months. Mom wrote a letter for each hearing, telling the parold board what he did, and why he should not be paroled. This was a very dark and scary time in my mom's life, as she knew that he was aware that she wrote the letters that kept him from being paroled.
He served his entire 12 year sentence. Upon his release, my mom and our family went through years of anxiety, knowing that he was out, and not knowing how much responsibility he took for his actions and subsequent incarceration, and how much he blamed on my mom....or, where he was, physically.
It has been over 20 years since he has been out of jail, and we never heard from him again.
A simple, inexpensive background screening could have prevented the entire situation.
A lawsuit was brought against the HOA, and the construction company, and my mom spent years and years being scarred and scared. None of this was necessary.
Remove the gray area from all of your hiring decisions.
