Case Study - Felony Theft and Habitual Traffic Offender Convictions

The Issue:

A Truck Dealership received an application for a sales position. In order to take steps to provide a safe work environment for their employees, Nation Search was engaged to do a felony background check on the applicant...a criminal background investigation.


The Action Taken by Nation Search:

Nation Search performed a comprehensive criminal search, consisting of SSN trace, Federal, County, and Department of Corrections search, driving history, and sex offender search.


The Conclusion:

The comprehensive criminal search turned up court documents reflecting a history of habitual driving offenses, in 1997 and 1998. Then a Felony Theft guilty plea, and conviction for Theft of $500-$15,000 in 2000. The individual was sentenced to 4 years probation, 60 hours of community service, and fines.

No offenses were uncovered by Nation Search since the 2000 theft conviction. Hopefully, this applicant has learned their lesson, and has proceeded down the path of better choices. Whether an employer will give them a chance, is up to them.

We certainly wish them well.

Case  Study - Reckless Endangerment and Second Degree Burglary

Convictions: 

County Misdemeanor Conviction of Reckless Endangerment of a Child, and Felony Conviction for 2nd degree Burglary and Felony Conviction for Distribution of Imitation Controlled Substance.

The Issue:

A well known Remodeling company received a few applications for job openings. Nation Search was contacted to assist them in obtaining background information on these individuals, to enable them to make a more informed hiring decision.


The Action Taken by Nation Search:

Nation Search performed a county criminal search, consisting of SSN trace, driving history, and instant credit check, on the applicants.


The Conclusion:

This company received a double whammy, regarding the results of the searches.

The single county search turned up court documents on 2 of the applicants, showing that one of the applicants had a felony conviction of 2nd degree burglary, of a dwelling, in 2007, and a misdemeanor conviction of reckless endangerment of a child. The applicant plead guilty to all counts, and was sentenced to 48 hours of community "service", probation, and fines. His probation was later revoked, due to his behavior, and he was sentenced to 4 years of community "corrections". (Halfway house, or ankle bracelet, etc.). The applicant still has misdemeanor offenses being reported in 2010.

Another applicant had been convicted of Felony Distribution of an imitation controlled substance, in 1999, and 2006, plus various driving related convictions, and had been sentenced to prison for 18 months. The applicants bad behavior regarding misdemeanor offenses, also, have continued to be reported in 2010.

This information enabled the remodeling company to make an informed hiring decision, which could have saved them time, money, and the aggravation that comes with making a bad hiring decision.

Case Study - County Court Felony Incest Conviction

The Issue:

A Temporary Employment Agency, hired to assist in the staffing of their client companies, contracted Nation Search to support them in obtaining background information on their various applicants. They wanted to ensure their clients that the expectation of due diligence, had been performed, on their part.


The Action Taken by Nation Search:

Nation Search performed a county criminal search, consisting of SSN trace, driving history, and instant credit check, on the applicants.


The Conclusion:

The single county search turned up court documents reflecting a guilty plea, and conviction for Incest, in 1999. The individual was sentenced to 8 years in prison, and sex offender treatment.

Upon release, this individual managed to rack up a slew of driving misdemeanors, in 2009.

Whether this applicant is a desirable employee, or not, is yet to be determined. With the information Nation Search provided, the temp. agency can provide full disclosure to their client, who is the ultimate decision maker.

The Issue:

A Car Dealership was performing their due diligence, with regards to an applicant. They wanted more information on the prospective employee.

Nation Search was engaged to assist the Dealership in obtaining background information on this individual, to enable them to make a more informed hiring decision.

The Action Taken by Nation Search:

Nation Search performed a comprehensive background search, consisting of SSN trace, County and Federal Criminal search, State Department of Corrections (DOC) search, driving history, and sex offender search.  
 
The Conclusion:

The single county search turned up court documents showing that the applicant does have a criminal background record.  He had an incident in 2007, in which he was charged with 4 criminal acts: criminal attempt, intimidating witness/victim, knowingly reckless child abuse..no injury, and assault 2..drugging victim. The applicant plead guilty to Assault in the 2nd degree...Drugging a Victim, which is a felony conviction. In pleading guilty to the felony charge, the other charges, which were misdemeanors, were dismissed.

In addition, this applicant had a spotty record of misdemeanor charges during the 7 year period Nation Search investigated, including, disturbing the peace, driving without a valid driver's license, and driving while under the influence.

These convictions were reported to the client, along with the felony conviction, and a timeline, of occurrences. Thus enabling the potential employer to make a much more informed hiring decision that would have otherwise been possible.

Federal and State Criminal Convictions For Alcohol Related Convictions

The Issue:
A Housing Authority agency was considering the hiring of an individual, and requested that a background check be performed. The Housing Authority administration felt that they needed more information, in order to make an informed hiring decision.

This particular individual, from a very young age, had developed a record of, alcohol related, repeat offender, misdemeanor convictions. The potential employer was eager to learn if this behavior had continued, or if the individual had taken the necessary steps to eliminate this undesirable cycle of behavior.

The Action Taken by Nation Search:
Nation Search performed a full comprehensive criminal screening. This screening consisted of, Instant Individual State, motor vehicle, sex offender registry search, SSN trace, and State DOC (Dept. of Corrections) search, and Federal criminal search.

The Conclusion:
Nation Search's investigation affirmed that the applicant did, indeed, have a history of unlawful acts, involving liquor. The research divulged that this potential employee had been charged with no less than 17 misdemeanor, alcohol related charges, and plead guilty to 14, during the past 7 year period we were investigating.

The charges ranged from disorderly conduct and unlawful liquor acts, under 21 liquor in body, liquor in vehicle passenger possession, at least 6 counts of unlawful possession of alcohol by minor, unlawful sale/supply of alcohol...leading to obstruction of justice, driving while license suspended and domestic violence charges.

No further information has been updated on this individual since 2009. No information is available as to whether this company decided to take a chance on this individual. NationSearch.com provided them with the information they needed in order to make this difficult decision.

Case Study - State Conviction for Murder

The Issue:

An applicant was being considered for a position as a laborer at a roofing company. The applicant had made the potential employer aware that they were currently on parole for murder. In completing their "due diligence", the company requested further information from NationSearch.com, in order to make a more informed hiring decision.

The Action Taken by NationSearch.com:
Nation Search performed a full comprehensive screening, which includes the following....sex offender search, County and Federal Criminal, and Dept. of Corrections search.

The Conclusion:
The screening revealed that the candidate had a conviction, at the State level, of murder, committed in 1983, and is currently on parole.

The employer was aware that the applicant was on parole for felony murder. However, that information, in and of itself, was not sufficient for the employer to make their decision. NationSearch.com provided vital, detailed, information to the employer, which assisted them in making a fully informed decision.

The Issue:

An individual was under consideration for a Sales Position at an International company.  The company needed more information, in order to make an informed hiring decision.

This particular applicant indicated that they were hightly educated, and had once held a high level, international, position with the government.  Therefore, our client was lured into a false sense of security, and subsequently made a decision that a very minimal background search was warranted.....instant nationwide and single county search, only.

The Action Taken by NationSearch.com:

Nation Search met with our client, and advised them of the potential ramifications of such a narrow search.  The consultation resulted in a request for an expanded search.

Nation Search performed a full comprehensive screening, sex offender search, Federal Criminal, and Dept. of corrections search.

The Conclusion:

The research revealed that the candidate had a conviction, at the State level, of grand larceny, and was currently on parole.  The Federal Criminal search produced a conviction of fraudulent statements, and misrepresentation.  The applicant was currently on probation for the Federal charge.

The minimal instant nationwide search would not have revealed the Federal conviction, and the overall "questionable" character of the applicant.

Nation Search has a duty to counsel our clients, based upon 16 years of experiance, and instinct, in the background screening industry.  Our job does not end with "doing exactly what the client has contracted for".  Our job is to do everything possible to assist them in providing a safe work environment.

In the post 9/11 era, the fact that this applicant said that he had worked in a high ranking government position, would indicate that they had been cleared by homeland security, and therefore, was an upstanding citizen.....not so.

Don't put your company in jeopardy.  Criminals can be very cunning and manipulative.  Beware.

Case Study - Federal Conviction For Child Abuse

The Issue:

A Staffing agency was conducting their due diligence, with regard to an applicant.  They wanted more information on the prospective employee.

Nation Search was engaged to help the Staffing agency learn more about the candidate in order to make an informed hiring decision.

The Staffing agency only authorized Nation Search to perform a single county search.

The Action Taken by NationSearch.com:

NationSearch advised that a single county search would not provide sufficient information to the client, but went ahead and did the search as requested.

The Conclusion:

The single county search turned up a court document showing that the application had an incident in 1992, with no indicated disposition.  With the request for the background search being made in 2009, the county record had exceeded the 7 year scope, for which the client requested.

The record was supplied to the client.  Considering the vagueness of the record, the client requested more information.

Nation Search then did a comprehensive background search, which includes County, State, and Federal jurisdictions.  The investigation indicated a criminal conviction, and that the applicant was, in fact, still on parole for that conviction.  The conviction being child abuse, resulting in death.

The minimal search did not provide the information necessary to make an informed hiring decision.  The case could have resulted in a couple of very different endings....innocent, and released or, convicted, jailed, and parole.  Each resulting in a very different hiring decision.
